19.3 Regarding liability, OYA Play has implemented a limitation that caps its potential financial responsibility to users. Specifically, OYA Play's liability is limited to the fees you paid to the platform over the 12 months preceding any claim. This limitation is designed to provide a clear framework for potential disputes while also protecting the company from excessive financial risk.
19.4 This liability cap applies to various situations, including but not limited to service disruptions, data loss, or other issues that might arise from using the platform. It's crucial for users to understand this limitation when considering their engagement with OYA Play's services and when making decisions about the extent of their investments or activities on the platform.
19.5 By using OYA Play's Services, users implicitly agree to these terms, accepting the platform as it is and acknowledging the limitations on OYA Play's liability. This agreement forms part of the broader terms of service that govern the relationship between OYA Play and its users, ensuring a clear understanding of expectations and responsibilities on both sides.
All disputes shall be resolved through binding arbitration, governed by the rules of British Virgin Islands International Arbitration Centre. Parties waive the right to jury trials or class-action statuses when resolving conflicts linked to the platform.
These Terms are governed by the laws of British Virgin Islands. In cases of legal ambiguity, the platform will act in accordance with the applicable regulatory frameworks and local agreements.
Evolving Services and Continuous Improvements: OYA Play may introduce new features, redesign existing functionalities, or retire tools at any time. We cannot guarantee perpetual operation of older features as innovation evolves.
Controlling Your Preferences and Notifications: By using the platform, you consent to receiving notifications, updates, and announcements from OYA Play. Marketing emails can be managed through your account preferences or the unsubscribe options provided.
Consequences of Violations, Enforcement Actions, and Recourse for Damages: Violating these Terms grants OYA Play the authority to suspend accounts, restrict wallet interactions, or take legal action to prevent damages to the platform ecosystem.
